A recent ruling from the São Paulo Court of Justice allows Uber Moto and 99Moto services to resume operations in the city, overturning the previous ban by São Paulo City and halting the daily fine of R $ 1 million faced by the companies for providing the service.
Banning is not the answer, argues the judge.
The judge emphasized that new laws and simple bans are not the answer to motorcycle-related traffic issues. He stated that while the prefecture can regulate the service, it cannot outright prohibit it. This echoes a previous ruling by the 8th Public Finance Court in February regarding a decree by Mayor Ricardo Nunes.
If the amount of accidents rises, it indicates that the inspection procedures are not thorough or effective enough.
The judge’s decision referenced data from the companies which showed that just 0.0003% of trips taken with Uber Moto and 99Moto in São Paulo over two years resulted in accidents. This figure was well below the national average, with over half a million trips completed during that time.

Moto mentioned in a message that the service is primarily utilized by people living on the outskirts as a quicker and cost-effective way to travel within the city.
The prefecture stated that you will seek refuge.
The City of São Paulo will appeal the decision of the TJ-SP to maintain the ban on bike apps services and continue inspections.
